Arson charges against two McDonough County residents dismissed

MCDONOUGH COUNTY, Ill. (WGEM) - Charges against two McDonough County residents accused of burning down a restaurant back 2011 have been dropped.

McDonough County State's Attorney James Hoyle says arson charges against Ricky Roberts, of Macomb, and Allison Roberts, of Bushnell, have been dismissed. The two suspects were alleged to have caused the 2011 fire that destroyed the Brickhouse Restaurant in Bushnell.

Hoyle says the charges were dropped because of conflicting results of the investigation.

Five fire investigators reviewed the incident. Out of the first four, only one concluded it was arson while the other three determined it inconclusive despite the fire being suspicious in nature. The last investigator concluded the fire was not arson.

"I maintain that the charges from the grand jury were warranted against the parties given this particular fire and when considering the parties history of unexplained fires," Hoyle said in a release. "Given the conflicting conclusions about the cause of the fire, I concluded I could no longer mee the burden of proof at trial of beyond a reasonable doubt."
